About Me
Mark B. Weinberg founded the firm that is today Weinberg, Jacobs & Tolani, LLP, manages the Tax Exempt Organizations Practice Group, and co-manages the Estate Planning and Administration Practice Group within the firm. He graduated from the University of Chicago Law School in 1970, then served for over six years with the Chief Counsel's Office of the Internal Revenue Service. There he was responsible for matters concerning the creation, governance and tax exemption of nonprofit organizations, charitable giving and estate and gift tax issues. He left government service in 1977 to enter private practice with one of Washington's largest firms, and in 1985 set out to create the firm that became the AV rated Weinberg, Jacobs & Tolani, LLP. Mr. Weinberg advises and represents a wide variety of charities, including The National Academy of Sciences, the National Academy of Engineering and the Institute of Medicine, The Ellison Medical Foundation, The Air Force Association, the American Antitrust Institute, Friends of the University of KwazuluNatal and other public charities, private foundations and their high net worth patrons throughout the United States and the world. He speaks and writes frequently on issues relating to grant making and presents new ideas in the use of public charities, private Foundations and donor advised funds in international and domestic settings for professional and general public audiences. His practical experience includes successfully resolving several extensive IRS audits of public charities, private foundations and other nonprofits and their patrons, obtaining private letter rulings for public charities and private foundations on a wide variety of tax issues, and advising the Treasury Department and Internal Revenue Service on issues in grant making. . Mr. Weinberg is admitted to practice in Maryland, the District of Columbia, and Pennsylvania. He is an elected fellow of the American College of Trust and Estate Counsel, an active member of long standing in the Probate and Trust Law Division, the Tax Section and Exempt Organizations Committee of the American Bar Association. He is also a member of the D.C. Estate Planning Council.

Celebrity‐Charity Relationships: Knowing a Heartache When You See One Contributed by: Mark WeinbergWednesday, January 25, 2012 (1 years 109 days ago) Big donors to charity have always benefitted from the public approval their gifts create. Naming a building or a professor’s chair after a contributor is accepted behavior for churches, synagogues, universities and hospitals; the IRS approves of it. That donors benefit from making a gift contingent on their name appearing on the structure or program is incidental and tenuous. Corporations that sponsor charitable events get this kind of recognition, and the charity is not taxed on the receipt unless it is equivalent to advertising. The question is whether celebrities who contribute their services to put on an event, advertise a cause or share the spotlight with charity in other ways can receive more than public adoration, image building and name recognition for their trouble. Problems arise at the point the celebrity’s interaction with the charity results in more than that incidental and tenuous benefit to the celebrity.
